The Office of Critical Minerals and Energy Innovation (formerly the Office of Energy Efficiency and Renewable Energy) of the Department of Energy (DOE) has reviewed the petroleum-equivalency factor (PEF) for electric vehicles (EVs) used by the Environmental Protection Agency (EPA) in calculating light-duty vehicle manufacturers' compliance with the Department of Transportation's (DOT) Corporate Average Fuel Economy (CAFE) standards. DOE has determined that revisions to the PEF are necessary. DOE is first publishing a final rule that removes the fuel content factor (FCF) from the calculation of the PEF. Removal of the FCF is consistent with a United States Court of Appeals for the Eighth Circuit decision that held, among other things, that the inclusion of the FCF in the PEF calculation exceeded DOE's authority under the substantive statute. DOE will propose additional revisions to the PEF in a forthcoming notice of proposed rulemaking.
The U.S. Department of Energy (DOE) is amending its regulations in compliance with a United States Court of Appeals for the Eighth Circuit court decision vacating the March 29, 2024 rule revising procedures for calculating a value for the petroleum-equivalent fuel economy of electric vehicles (EVs) used by the Environmental Protection Agency (EPA) in calculating light-duty vehicle manufacturers' compliance with the Department of Transportation's (DOT) Corporate Average Fuel Economy (CAFE) standards.
The Environmental Protection Agency (EPA) is taking final action to approve a revision to the Maricopa County Air Quality Department (MCAQD) portion of the Arizona State Implementation Plan (SIP). This revision concerns emissions of volatile organic compounds (VOCs) from petroleum solvents used in dry cleaning. We are approving a local rule that regulates these emission sources under the Clean Air Act (CAA or "Act").
Through this final rule, the Bureau of Land Management (BLM) rescinds and replaces the "Management and Protection of the National Petroleum Reserve in Alaska" final rule, issued on May 7, 2024, to restore regulatory clarity and align BLM's implementing regulations with statutory requirements and national energy policy.

As a result, DOE delays the effective date of the direct final rule on the procedures for acquisition of petroleum for the Strategic Petroleum Reserve (SPR) to require index-priced contracts.

The revisions include adding incorporations by reference to other state rules, adding definitions specific to the rule, revising unnecessarily restrictive or duplicative language, and making administrative wording changes. These revisions do not impact the stringency of the SIP or have an adverse effect on air quality. The EPA's final approval of this rule revision is being done in accordance with the requirements of the Clean Air Act (CAA).

Congress has passed and the President has signed a joint resolution of disapproval under the Congressional Review Act (CRA) of the Environmental Protection Agency's (EPA) final rule titled, "Waste Emissions Charge for Petroleum and Natural Gas Systems: Procedures for Facilitating Compliance, Including Netting and Exemptions" (2024 WEC Final Rule). The 2024 WEC Final Rule implemented and facilitated compliance with the requirements of the Waste Emissions Charge in the Clean Air Act's (CAA) Methane Emissions Reduction Program. Under the joint resolution and by operation of the CRA, the 2024 WEC Final Rule now has no legal force or effect. Because the rule has been nullified, the EPA is removing it from the Code of Federal Regulations (CFR). This action is exempt from notice-and-comment rulemaking because it is ministerial in nature.
This DFR amends the regulations for the procedures for acquisition of petroleum for the Strategic Petroleum Reserve (SPR) to require index-priced contracts. This change is made to align DOE's processes with industry practice. Additionally, it restores the rule to its historical norm.
