The Environmental Protection Agency (EPA) is proposing to approve a revision to the District of Columbia (DC, the District)'s title V operating permits program, submitted on behalf of the District by the Department of Energy and Environment (DOEE). The revision updated title V operating permit fees collected by DOEE in order to ensure that the title V operating program will continue to be adequately funded. The revision also reorganized some sections in Chapter 3 with no substantive change in content. This action is being taken under section 502 of the Clean Air Act (CAA).
The Environmental Protection Agency (EPA) is proposing to approve the negative declarations submitted by the District of Columbia Department of Energy and Environment (DCDOEE) on July 19, 2024 and August 28, 2024. The negative declarations submitted by the DCDOEE certify that there are no existing large municipal waste combustors (LMWC), crude oil and natural gas facilities, or electric utility generating units subject to sections 111(d) and 129 of the Clean Air Act (CAA) within the jurisdiction of the District of Columbia.
The Environmental Protection Agency (EPA) is proposing to approve a state implementation plan (SIP) revision submitted by the Department of Energy and Environment (DOEE, the "Department") on behalf of the District of Columbia (DC, the "District"). The revisions pertain to creating a synthetic minor permit program and resolving the regulatory differences between the District's current regulations and those regulations approved previously in Chapters 1 and 2 of the Air Quality Regulations. The intended effect of this action is to enable DC to create federally enforceable synthetic minor permit conditions for sources of criteria pollutants pursuant to section 110 of the Clean Air Act (CAA, the "Act"). This action is being taken under the CAA.
The U.S. Parole Commission is adopting a final rule to remove and reserve a procedural rule which concerns prisoners serving any combination of U.S. and D.C. Code sentences that have been aggregated by the U.S. Bureau of Prisons ("mixed code" offenders) and considered for parole on the basis of a single parole eligibility and mandatory release date on the aggregate sentence.
The Environmental Protection Agency (EPA) is finalizing multiple actions related to the Washington, DC-MD-VA nonattainment area (the Washington Area or the Area) for the 2015 8-hour ozone national ambient air quality standards (2015 ozone NAAQS). First, the EPA is determining that the Washington Area attained the 2015 ozone NAAQS by the applicable attainment date of August 3, 2024. Second, the EPA is determining that the Washington Area has clean data under the EPA's Clean Data Policy. Lastly, the EPA is taking final action on an exceptional events request submitted by the District of Columbia (DC) on March 20, 2024, and concurred on by the EPA on July 17, 2024. This action addresses the EPA's obligation under Clean Air Act (CAA) sections 179(c) and 181(b)(2) to determine whether the Washington Area attained the 2015 ozone NAAQS by the August 3, 2024 attainment date and, as set forth in the EPA's Clean Data Policy, will suspend the obligation of DC, the State of Maryland (MD), and the Commonwealth of Virginia (VA) to submit certain attainment planning requirements for as long as the Washington Area continues to attain the 2015 ozone NAAQS. This action is being taken under the CAA.
The Coast Guard is establishing a temporary safety zone for waters between the 14th Street Bridge to the north and the Woodrow Wilson Bridge to the south. The safety zone is needed to protect the public and vessels from potential hazards created by an aircraft collision on the Potomac River. Additionally, the safety zone is needed to ensure a safe working environment for the first responders and dive teams from passing traffic. This rule will prohibit persons or vessels from entering this zone unless specifically authorized by the Captain of the Port (COTP) Sector Maryland-National Capital Region (NCR) or a designated representative.
