The Environmental Protection Agency (EPA) is approving certain portions of State Implementation Plan (SIP) revisions submitted by the State of North Dakota (North Dakota) on January 12, 2015, and August 11, 2022, to address regional haze. Specifically, the EPA is approving North Dakota's nitrogen oxides (NO<INF>X</INF>) Best Available Retrofit Technology (BART) determination for Coal Creek Station power plant (Coal Creek) for the first implementation period of the regional haze program and North Dakota's five-year regional haze progress report. This action addresses the United States Court of Appeals for the Eighth Circuit's September 23, 2013, vacatur and remand of the portion of EPA's 2012 Regional Haze Federal Implementation Plan (FIP) that promulgated a BART emission limit of 0.13 pounds per million BTU (lb/ MMBtu) NO<INF>X</INF> (30-day rolling average) for Coal Creek. The EPA is taking this action pursuant to the Clean Air Act (CAA).
The Environmental Protection Agency (EPA or the Agency) is approving the Wyoming partial coal combustion residuals (CCR) permit program under the Resource Conservation and Recovery Act (RCRA). After reviewing the CCR permit program application submitted by the Wyoming Department of Environmental Quality (WDEQ), EPA has determined that Wyoming's partial CCR permit program meets the standard for approval under RCRA. Wyoming's partial CCR permit program will operate in lieu of the Federal CCR program, with the exception of the specific provisions noted below.
The U.S. Environmental Protection Agency (EPA) is finalizing the repeal of specific amendments to the National Emission Standards for Hazardous Air Pollutants (NESHAP) for Coal- and Oil-Fired Electric Utility Steam Generating Units (EGUs), commonly referred to as the Mercury and Air Toxics Standards (MATS), that were promulgated on May 7, 2024. Specifically, the EPA is repealing the revised filterable particulate matter (fPM) emission standard, which serves as a surrogate for non-mercury hazardous air pollutant (HAP) metals for existing coal- fired EGUs; the revised fPM emission standard compliance demonstration requirements; and the revised mercury (Hg) emission standard for lignite-fired EGUs. The EPA is also making technical, non-substantive clarifications to electronic reporting requirements.
Due to the receipt of a substantive comment on the direct final rule (DFR) rescinding portions of the Bureau of Land Management's (BLM) regulations that address the Leasing of Solid Minerals Other Than Coal and Oil Shale, the Department of the Interior, through the BLM, is issuing a new final rule that responds to the comment.
On May 8, 2024, the Environmental Protection Agency established regulatory requirements, including compliance deadlines, for legacy coal combustion residuals surface impoundments and coal combustion residual management units under the Resource Conservation and Recovery Act. This action extends the existing deadlines for owners and operators of active coal combustion residual facilities or inactive coal combustion residual facilities with a legacy coal combustion residual surface impoundment to comply with the facility evaluation requirements for identifying coal combustion residual management units. This action also extends the existing deadline for owners and operators of coal combustion residual management units to comply with the groundwater monitoring provisions and the remaining provisions for coal combustion residual management units. Finally, EPA is taking final action on several rule amendments that were proposed on January 16, 2025, to correct errors and clarify the coal combustion residual regulations.
The Environmental Protection Agency (EPA or the Agency) is extending the comment period for the proposed rule entitled "Hazardous and Solid Waste Management System: Disposal of Coal Combustion Residuals From Electric Utilities; Extension of an Alternative Closure Requirement Deadline." EPA is extending the comment period until February 6, 2026, in response to stakeholders' requests for a comment period extension.
The Environmental Protection Agency (EPA or the Agency) is proposing to extend, by three years, one compliance deadline applicable to certain coal combustion residuals (CCR) surface impoundments operating pursuant to the alternative closure requirements. Specifically, EPA is extending the deadline for owners and operators to complete closure of their unlined CCR surface impoundments larger than 40 acres from October 17, 2028, to October 17, 2031. This deadline extension will promote electric grid reliability by allowing a subset of coal-fired power producers to continue to operate beyond their currently scheduled retirement date.
This direct final rule revises the Federal regulations to rescind language identifying obsolete funds as part of the moneys that the Office of Surface Mining Reclamation and Enforcement (OSMRE) must distribute to eligible States and Tribes each fiscal year. The existing regulations refer to prior balance replacement funds, which are moneys from the United States Treasury's General Fund that replaced State or Tribal share funds that were allocated before October 1, 2007, but never appropriated by Congress.

EPA is reopening the comment period to propose its intention to approve additional revisions to the North Dakota CCR permit program which, if finalized, will provide North Dakota with additional authority to implement a State CCR permit program. The Agency is reopening the comment period to accept comments on the proposed revisions and EPA's evaluation of the changes.

The Mine Safety and Health Administration (MSHA) is extending the comment period on the proposed rule titled, "Electronic Surveying Equipment in Underground Coal Mines," published in the Federal Register on July 1, 2025, with an established public comment period that is scheduled to end on July 31, 2025. In response to a request for additional time to develop and submit comments on the proposed rule, MSHA is extending the comment period for an additional 30 days, from July 31, 2025, to September 2, 2025.

This May 8, 2024 rule (Legacy Final Rule) established regulatory requirements for legacy coal combustion residuals (CCR) surface impoundments and CCR management units (CCRMU) under the Resource Conservation and Recovery Act (RCRA). This proposal seeks comment on issues discussed in the direct final rule published in this Federal Register to establish an additional option for owners or operators of active CCR facilities or inactive CCR facilities with a legacy CCR surface impoundment to comply with the Facility Evaluation Report (FER) Part 1 and to extend compliance deadlines for the remaining CCRMU provisions published in the Legacy Final Rule. EPA is also soliciting comment on extending the deadline to prepare both FER Part 1 and Part 2 by 12 months.

MSHA proposes to revise title 30 of the Code of Federal Regulations (30 CFR) part 75 by removing requirements for the use of permissible electric face equipment in coal seams above the water table. Removing these provisions would not reduce protections afforded to miners.
MSHA is proposing to revise 30 CFR part 75 by removing duplicative requirements for electric cap lamps and other electric lamps in underground coal mines. These changes would clarify the permissibility requirements for electric cap lamps and other lamps while maintaining safety protections for miners using such equipment.

This final rule adjusts the amounts of civil monetary penalties contained in the Bureau of Land Management's (BLM) regulations governing onshore oil and gas operations and coal trespass. This final rule is required by the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015 and is consistent with applicable Office of Management and Budget (OMB) guidance. The adjustments made by this final rule constitute the 2025 annual inflation adjustments and account for one year of inflation spanning the period from October 2023 through October 2024.
