The FHWA is removing outdated and duplicative regulations requiring State highway agencies to submit to FHWA, on an annual basis, Equal Employment Opportunity (EEO) Program plans for FHWA approval. Currently, FHWA is responsible for oversight of State highway agencies' EEO programs, which include collection and analysis of internal employment data, development of an internal affirmative action hiring plan, and contractor compliance reporting. These regulations overlap with, and are duplicative of, other Federal requirements enforced by other Federal agencies. In addition, an Executive order (E.O.) issued by President Donald J. Trump repealed a previous E.O. that was relied on to initially promulgate the regulation. Elimination of these regulations will reduce administrative and monetary burdens on Federal- aid recipients.
The FHWA is correcting a clerical error in a final rule that appeared in the Federal Register (FR) on April 18, 2025. The final rule repealed a requirement that State departments of transportation (State DOT) and metropolitan planning organizations (MPO) establish declining carbon dioxide (CO<INF>2</INF>) targets for the greenhouse gas (GHG) measure and report on progress toward the achievement of the target.

This document delays the effective date of the final rule, published on January 14, 2025, titled Buy America Requirements for Manufactured Products.
The FHWA is extending the comment period for a notice of proposed rulemaking (NPRM) and request for comments, which was published on November 13, 2024. The original comment period is set to close on January 13, 2025. The extension is based on concerns expressed by stakeholders that the January 13, 2025, closing date does not provide sufficient time to review and provide comprehensive comments. The FHWA recognizes that others interested in commenting may have similar concerns and agrees that the comment period should be extended. Therefore, the closing date for comments is changed to February 12, 2025, which will provide stakeholders and others interested in commenting additional time to discuss, evaluate, and submit responses to the docket.
This final rule amends FHWA's Buy America regulation to terminate FHWA's general waiver for manufactured products and establish Buy America requirements for manufactured products with respect to Federal-aid highway projects. The standards for applying Buy America to manufactured products are generally consistent with the Office of Management and Budget's (OMB) guidance implementing the Build America, Buy America Act (BABA) provisions of the Infrastructure Investment and Jobs Act (also known as the Bipartisan Infrastructure Law (BIL)).
