In 2022, the U.S. Consumer Product Safety Commission (CPSC) published a consumer product safety standard for crib mattresses under section 104 of the Consumer Product Safety Improvement Act of 2008 (CPSIA). The standard incorporated by reference ASTM F2933-21, Standard Consumer Safety Specification for Crib Mattresses, with modifications to make the standard more stringent. The CPSIA sets forth a process for updating mandatory standards for durable infant or toddler products that are based on a voluntary standard, when a voluntary standards organization revises the standard. Consistent with the CPSIA update process, this direct final rule updates the mandatory standard for crib mattresses to incorporate by reference ASTM's 2025 version of the voluntary standard, while maintaining certain modifications.

This document corrects the preamble to a final rule published in the Federal Register on December 15, 2025, regarding requirements for neck floats under CPSC's mandatory toy safety standard. This correction addresses errors and revises text to provide clear instructions to the public to access voluntary standards that are incorporated by reference.
Section 106(a) of the Consumer Product Safety Improvement Act of 2008 (CPSIA) mandates that ASTM F963 shall be a mandatory toy safety standard. ASTM F963-23, however, does not establish specific performance requirements for aquatic toys, such as neck floats. The U.S. Consumer Product Safety Commission (CPSC or Commission) is issuing this final rule establishing additional performance requirements specifically for neck floats and revised labeling requirements for neck floats to address fatal hazards associated with neck floats. The Commission is also amending CPSC's list of notice of requirements (NORs) to include neck floats.

The U.S. Consumer Product Safety Commission (Commission or CPSC) is formally withdrawing certain notices of proposed rulemaking issued between October 2009 and July 2024. The Commission does not intend to issue final rules with respect to these proposals. If the Commission decides to pursue future regulatory action in any of these areas, it will issue a new proposed rule.
On January 8, 2025, in consultation with U.S. Customs and Border Protection (CBP), the U.S. Consumer Product Safety Commission (Commission or CPSC) issued a final rule to revise the agency's regulation for Certificates of Compliance (certificates). The final rule contained two "effective dates" for products subject to the final rule based on how products were manufactured or imported into the United States. CPSC is making a technical correction to the DATES section of the final rule because the Office of the Federal Register requires one "effective date." The corrected final rule will contain one "effective date" for the final rule and two "applicability dates" based on how products are manufactured or imported into the United States. This technical correction has no substantive effect on the dates by which products subject to the final rule must be in compliance.

The Consumer Product Safety Commission is withdrawing its proposed rule to amend its regulations to require disclosure of relevant interests by persons seeking to make oral presentations, participate in adjudicative proceedings, or submit petitions for rulemaking to the Commission because the Commission has not taken any action on this proposed rule since it was published in September 2023.
The U.S. Consumer Product Safety Commission (CPSC or Commission) is withdrawing its proposed rule to amend section 6(b) of the Consumer Product Safety Act, 16 CFR part 1101 (6(b) Regulation). On February 26, 2014, the Commission issued a notice of proposed rulemaking in this matter (79 FR 10712). On February 17, 2023, the Commission issued a supplemental notice of proposed rulemaking (88 FR 10432). The Commission has not taken any action on this rule since it was published in February 2023.
The Consumer Product Safety Commission (Commission or CPSC) has received a petition requesting that the Commission establish a regulation for child-resistant above-ground and portable pool ladders to reduce the drowning deaths of children younger than 5 years of age, and particularly children between 1 and 3 years. The CPSIA sets forth a process for updating mandatory standards for durable infant or toddler products that are based on a voluntary standard, when a voluntary standards organization revises the standard. In November 2024, ASTM published a revised voluntary standard. This direct final rule updates the mandatory standard for stationary activity centers to incorporate by reference the 2024 version of ASTM F2012, which the Commission has allowed to become the mandatory standard under section 104. The purpose of the direct final rule is to conform the Code of Federal Regulations (CFR) to the correct version of ASTM F2012 to provide an accurate reference to the standard that will be enforced as a mandatory rule.

On August 1, 2024, ASTM approved a revised voluntary standard, and this direct final rule updates the mandatory standard for NFS cribs to incorporate by reference the 2024 version of ASTM F406.
